I wish it was true in the US. Here no-suit clauses are legal if arbitration is allowed as a substitute, which is total bullshit. The lesson is ALWAYS READ THE FINE PRINT!

Yes, we have (supposedly) independent arbitration systems for a lot of industries. The system is biased in favour of the consumer, in that you are not obliged to use them but can go straight to legal action if you wish; the company has to pay the fee whatever the result and the consumer never pays; and if you use them but are dissatisfied with the outcome, you can ignore it and proceed to court; whilst the company must accept the result and cannot appeal.

In practice, not many people will take it to court unless it has proved to be a really serious problem. But the company cannot stop you.

Maybe you need to exhume Ralph Nader as it appears that whilst America may have brought in consumer rights it is now a very long way behind Europe.

Nader’s heart was in the right place. Unfortunately he also was an unstable loose cannon which resulted in his hopeless run for the presidency that took votes from Gore and elected Bush.
